The amount declared to post bail is non-negotiable and varies greatly depending on the circumstances and charges of the arrest. Crimes held in federal court require a 15% minimum to be paid before release.

Bail Bond amounts are set by a Magistrate and are not negotiable without a motion for bond reduction hearing which can take several weeks to be scheduled on a docket and be heard in criminal court. At the bond reduction hearings, both the Attorney for the defendant and Attorneys from the State Attorney’s Office will be heard on their reasonings and recommendations. It will then be decided by a magistrate if the bail bond amount will stay the same or be reduced. For more information, on bond reduction hearings contact your attorney.

Bail is the designated amount the arrestee must pay to be released until they are formally determined innocent or guilty. This collateral is refundable, ensuring the defendant shows up to all required court proceedings. However, if the accused cannot afford to post bail by themselves, they may need the assistance of a qualified bondsman.
